1. This website is operated by 'The Gluten Free Cake House'. Where these terms and conditions use terms such as "we", "us" and "our" they refer to The Gluten Free Cake House

 

2. We offer this website, including all the information, tools and services available on it, on the condition that you accept these terms and conditions and the associated privacy policy available on our website.

 

3. By visiting our website and/or purchasing something from us, you are deemed to have accepted these terms and conditions.

 

4. You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions and ensure you understand them before making a purchase.​

 

GENERAL CONDITIONS​

 

5. We reserve the right to refuse service to anyone, for any reason, at any time.

 

6. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices.

 

7. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website.

 

8. Headings and titles used on this website are done so for convenience only. They do not constitute any part of the terms and conditions and will not limit or otherwise affect the terms herein.​

 

ONLINE STORE TERMS​

 

9. Our website offers a range of products and or services for sale. Where we refer to an 'item' or 'product' we are referring to a single product or service available for purchase on this website.

 

10. We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.

 

11. Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.

 

​Any cake ordered based on a photograph of a cake made by another cake maker, can only be reproduced as our interpretation and will not be an exact replica of the cake in question.

The colour of your cake order will be matched as closely as possible to the design agreed

Any photographs displayed on our website or on our social media channels are a guide only and the final cake design may vary slightly to these.

All sugarpaste figurines. models and toppers are handmade.These are not manufactured and may sometimes vary slightly to those displayed online.

 

In some extremely rare cases it may be necessary to slightly change or vary a design from what has been agreed, as specific cake decorating items may become unavailable/discontinued from our suppliers. If this occurs, we will ensure a substitute replacement is found with an equally or better quality product.

 

12. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

 

i) The item you have ordered is out of stock

 

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

 

iii) There has been a pricing or product description error

 

iv) There is a system or procurement failure

 

v) You have failed our customer validation checks

 

13. When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

 

14. Your order will only be accepted by us once your goods have been dispatched.​

 

MODIFICATIONS TO OUR SERVICE AND PRICING​

 

15. Prices for items are subject to change without notice.

 

16. We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.

 

17. We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.​

 

DELIVERY & COLLECTION

 

​Cake Collection

 

Your cake order should be collected at the time agreed after placing your order and agreed with us. If for any reason you are unable to make this agreed time, we must be informed with sufficient time to re-arrange. We do not take any responsibility if your order fails to be collected on the arranged day due to issues with business opening hours.

All cake orders will be pre-boxed for the customer for transportation. Customers are advised to check their order at the time of collection, once received we will assume the customer is satisfied. After the customer has received the order it is the sole responsibility of the customer. We will not accept responsibility for damage caused

by you or by any other persons nominated by you to collect your order. Any repairs or adjustments will incur additional charges. Once the order leaves our premises, we cannot be held responsible for any damage.

 

Cake Delivery & Set Up

 

18 We will only deliver cakes within a 40 mile radius of our location, any further than this increases the possibility of damage in transit due to lengthy travel.

A delivery charge, if requested will be given at the time of placing your order. This will be based on distance required to travel, date, time and, if applicable, also include the cost of the safe installation and set up of your cake.

 

19 Venue parking should be available for delivery. If unavailable, any parking fees will be added to your final payment.

If you have a specific delivery date and require delivery before a given time, please ensure this is specified when placing your order.

It is the customer's responsibility to ensure the correct delivery information is given and that pre-arrangements have been made with the venue for the location and display of your cake. Set up does not include cake table or area decoration.

The Gluten Free Cake House cannot be held responsible for the location of the cake at the venue.

Please ensure, that the display location is level, stable and strong enough to hold the cake. If the order is to be left unattended at the venue, we cannot be held responsible for any damage or loss occurring after we have left the venue.

We reserve the right to photograph the order on delivery and these photographs remain our property.

 

On occasion we are faced with severe weather conditions or other unexpected events that may make your venue inaccessible. We will always do our best to deliver as pre-arranged. In the unlikely event that our delivery vehicle becomes involved in an accident, and

your order gets damaged, we will provide you with a full refund which will include the cost of the order and delivery fee. We will not be liable to any further charges.​

 

ORDER CANCELLATION

 

20. If you wish to cancel an order you have placed you must contact us immediately to ascertain whether this is possible. As your cake order is reserved and designed soley for you, certain elements of your

cake order may be ordered months in advance.

 

21. Under the Distance Selling Regulations you do not have the legal right to cancel a made-to-order item, which includes edible goods. Depending on the circumstances, time and expense we have invested at that point any monies paid may not be refundable, we may cancel your order at our discretion. If for example items made have been purchased and ordered to place on the cake, then a refund would not be able to be given for these. In all circumstances our refund policy will apply.

 

22. If the customer fails to make the complete order payment by the date agreed The Gluten Free Cake House reserves the right to

automatically cancel the order.

 

We also reserve the right to cancel if we have insufficient stock or staffing levels to deliver the order. In the unlikely event of a cancellation, The Gluten Free Cake House will give customers as much advance notice as possible and offer a full refund of the cost of the cake order only. In the case of a date rescheduling, customers will be given the option to transfer to the rescheduled date.​

 

LIABILITY AND INDEMNITY​

 

23. We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

 

24. You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.​

 

JURISDICTION​

 

25. These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.​

 

ENTIRE AGREEMENT​

 

26. These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.​

 

GENERAL​

 

27. Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

 

28. Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
